2. What your notice must include

A notice that materials hosted by, or distributed through, the Site infringe intellectual property rights must include the following information:

  1. an electronic or physical signature of the person authorised to act on behalf of the owner of the copyright or other right allegedly infringed;
  2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
  3. a description of the material that you claim is infringing, and where it is located on the Site (please give the full web address, or URL, of each page);
  4. your name, address, telephone number and email address;
  5. a statement that you have a good faith belief that the use of the material you are complaining about is not authorised by the copyright owner, its agent or the law; and
  6. a statement that the information in your notice is accurate, and that you are the copyright or intellectual property owner, or are authorised to act on the owner’s behalf. If your notice is made under the laws of a country that requires it, this statement must be made under penalty of perjury.

If your notice is missing any of this information, we may not be able to act on it, and we may ask you to send it again with the missing details.

3. What happens next

When we receive a complete notice, we will normally:

  • review it and confirm that we have received it, usually within five (5) working days;
  • remove or disable access to the material, where this is appropriate under the law that applies;
  • tell the person who posted or supplied the material, and give them the chance to respond, which may include a counter-notice if they believe the notice is mistaken or that they have permission to use the material; and
  • restore the material if the notice is withdrawn, or if the law or a court requires us to.

We may pass your notice, including your name and contact details, to the person whose material is the subject of the complaint. We handle personal information in line with our Privacy Policy.

4. Accuracy of your notice

Please make sure that your notice is accurate and made in good faith. If you knowingly misrepresent that material is infringing, you may be liable for the damages and costs that we or the other party suffer as a result, depending on the law that applies. If you are not sure whether material infringes your rights, you may wish to get legal advice before sending a notice.

5. Repeat infringers

In appropriate circumstances, we will suspend or close the account of any user who is repeatedly found to have infringed the intellectual property rights of others.
